The COVID-19 pandemic brought unprecedented challenges to the nation and its healthcare system. Long-Term Care (LTC) providers were on the front lines fighting the effects of the virus, while protecting the most vulnerable population. Federal and State governments issued numerous directives to the LTC community as providers struggled to address the pandemic while facing staffing, personal protective equipment and other shortages, financial challenges and significant liability risks. 

LTC providers had to quickly develop policies to evaluate their clinical capability of caring for COVID-19 residents, determine whether to accept admissions from local hospitals and other providers, and develop “isolation units” to protect the existing resident population. They also were confronted with staffing and funding challenges, requiring the navigation and understanding of multiple governmental aid and loan programs, each with their own sets of conditions. And this was all in addition to the “constant” challenges of simply providing care to residents within the LTC continuum!  All of these issues bring significant liability risks to LTC providers, especially in states without a meaningful grant of immunity from state government.  

This session is designed to review these issues, through an analysis of the legal requirements imposed on LTC providers before, during and after this crisis, and the real-life operational issues that were then and are now confronted by providers. The presenters will review applicable legal requirements which pose the highest “compliance risks” to providers, and will provide recommendations on how to address and manage those risks today and moving forward.
